Employment Law & Litigation

Employment Law & Litigation Attorneys Serving Clients Nationwide

Few disputes carry higher stakes than those between employers and the people who work for them. A discrimination charge, a contested termination, or a broken employment agreement can put reputations, careers, and companies on the line. Kaufman & Hilbert PC counsels and represents both employers and executives in employment law matters and employment litigation. Based in Alpharetta, Georgia, and serving clients nationwide and internationally, the firm brings a senior-led model to every engagement: experienced attorneys handle your matter directly rather than passing it down a chain of associates. Whether you need to defend a claim, pursue one, or prevent one, we provide counsel built for high-stakes employment challenges.

How Kaufman & Hilbert Can Help

Employment law rewards preparation as much as advocacy. Our attorneys advise clients before disputes arise and represent them vigorously when litigation becomes necessary, including:

  • Employment litigation in state and federal courts, for employers and executives
  • EEOC charges, investigations, and position-statement responses
  • Discrimination, harassment, retaliation, and wrongful termination claims
  • Employment agreements — drafting, negotiation, and review
  • Severance agreements — negotiation and review

Our Employment Services

Employment Litigation

When an employment dispute reaches the courthouse, we represent employers defending claims and executives or professionals pursuing them. Our litigators handle discrimination, retaliation, wrongful termination, and contract-based claims with the same trial-ready discipline we bring to all litigation  — because well-prepared cases resolve on better terms.

EEOC Charges and Investigations

An agency charge is often the first formal step in an employment dispute, and how you respond shapes everything after. We guide employers through EEOC charges and investigations, prepare position statements, manage information requests, and develop strategy aimed at resolving matters before they become lawsuits. We also counsel individuals navigating the charge process.

Employment and Severance Agreements

Clear agreements prevent expensive disputes. We draft, negotiate, and review employment agreements for companies hiring key talent and for executives evaluating offers — compensation, equity, termination triggers, restrictive covenants, and confidentiality. Our business litigation experience shows us where agreements break down, so we draft to avoid those failure points. When departures come, we negotiate and review severance agreements on both sides of the table — clean, enforceable separations for employers, and fair terms that protect reputations and future opportunities for executives.

Who We Serve

We represent two sophisticated audiences. For employers — from emerging companies to established enterprises — we serve as employment counsel and litigation defense, helping manage workforce risk. For executives and professionals, we provide discreet, senior-level representation in disputes and in negotiating the agreements that govern their careers. Representing both sides sharpens our judgment: we know how the other side of every employment dispute thinks.

CASE CALLOUT MODULE

Walton v. James & Dean, Inc. (1985)

Robert J. Kaufman successfully defended the enforceability of his clients’ written employment agreement in a commission dispute, with the Georgia Court of Appeals holding that the agreement was clear and unambiguous. The court further held that, by accepting benefits and performing under the agreement without seeking rescission, the employee waived any claim that the contract was executed under duress; it remanded only to resolve a factual issue concerning whether compensation for services had been fully paid. Walton v. James & Dean, Inc., 177 Ga. App. 77, 338 S.E.2d 516 (1985)

Frequently Asked Questions

Both — with care to avoid conflicts. We represent employers of all sizes, and our individual clients are typically senior professionals with significant agreements or disputes at stake.

Take it seriously and respond strategically. Preserve relevant documents, avoid retaliatory action, and involve counsel before submitting a position statement. Early missteps in the agency process can follow you into litigation.

Generally, no — review it with counsel first. Severance agreements often include releases, restrictive covenants, and confidentiality terms with long-term consequences, and the initial offer is frequently negotiable.

Enforceability varies significantly by jurisdiction and drafting. Courts scrutinize scope, duration, and geography. We evaluate restrictive covenants case by case, for the companies relying on them and the individuals bound by them.
